| NYC Fire Deparment
Engineer Tamara Saakian, Director of Engineering
and Technology Management of the Bureau of Fire Protection and the
New York City Fire Department has examined the Hearth Cabinet. By
letter dated January 18, 2007, Ms. Saakian stated the Fire Department
has no objection to the Hearth Cabinet's use in NYC.

In his letter dated March 29, 2007, Engineer
Donald Gottfried, the Director of the Materials Equipment Acceptant
Division of the NYC Building Department, concurred with the Fire
Department's finding and also had no objection to the Hearth Cabinet's
use in NYC.
As a result, you can add a Hearth Cabinet
to an existing apartment, or you can add numerous units in a whole
building, without filing plans with the Building Department.
